After the terms of the agreement are modified by wuhui, if the user does not accept the modified terms, please stop using the services provided by wuhui immediately, and the user's continued use of the services provided by wuhui will be deemed to accept the modified agreement 1、 Definition of "app" service 1. Authority: refers to the unit that has the right to ask for inquiry, freezing or deduction of funds and other measures in accordance with laws and regulations, including but not limited to public security organs, procuratorates, courts, customs and tax authorities. 2. Function blocking: means that "app" has the right to prohibit the use of one or several functions of the illegal account according to the situation. 3. Account freezing: it means that "app" has the right to prohibit the use of illegal accounts for a certain period of time as the case may be. During the frozen account period, diamonds cannot be used for consumption, income, charm value cannot be withdrawn, exchanged, etc., and cannot be logged in or used during the frozen account period. 4. Equipment blocking: means that "app" has the right to prohibit the use of the equipment logged in by the illegal account for a certain period of time as the case may be. The login device blocked by the device cannot log in any account during the blocking period. 5. Permanent seal No.: the "app" has the right to permanently prohibit the use of the illegal account and delete the account information as the case may be and shall not register again. The virtual currency in the permanently sealed account will be deemed as the liquidated damages for the violation of this agreement by the user to be paid to wuhui company. 2、 Account registration 1. Users need to register an "app" account before using this service. The "app" account should be registered with the mobile number binding. Please use the mobile number that has not been bound with the "app" account. And the mobile phone number not banned by wuhui according to this agreement to register the "app" account. Wuhui can change the way of account registration and binding according to user requirements or product requirements without prior notice to users. 2. "App" is a mobile social product based on geographic location. When registering, users should authorize wuhui to disclose and use other geographic location information before successfully registering "app" account. Therefore, the user's completion of registration means that the user agrees to extract, disclose and use the user's geographic location information by wuhui. 3. In view of the binding registration method of "app" account, you agree that wuhui will automatically extract your mobile phone number, mobile device ID and other information for registration. 4. When users register and use the service, wuhui needs to collect personal information that can identify users so that wuhui can contact users when necessary, or provide users with a better use experience. The information collected by wuhui includes but is not limited to the user's name, gender, date of birth, ID card number, school situation, company situation, industry, city, frequent games, frequent stores, personal signature and membership card number; wuhui agrees that the use of these information will be limited by the third article of the user's personal privacy information protection. 3、 Description of application privacy rights 1. Respect for the privacy of user's personal privacy information is a consistent system of wuhui. Wuhui will take technical measures or other necessary measures to ensure the security of user's personal privacy information and prevent the disclosure, damage or loss of user's personal privacy information collected in this service. Remedial measures will be taken in a timely manner when the above circumstances are likely to occur. 4. Wuhui will not disclose the user's personal privacy information to any third party without the user's consent. However, the following specific circumstances shall not apply: 1) . wuhui provides the user's personal privacy information in accordance with the laws and regulations or the instructions of the competent authority; 2) . any disclosure of personal information caused by the user's informing or sharing the registered account and password with others, or other disclosure of personal privacy information not caused by wuhui; 3) . users disclose their personal privacy information to a third party; 4） . the user, WuHui and the cooperative unit have reached an agreement on the use of the user's personal privacy information. WuHui hereby discloses the user's personal privacy information to the cooperative unit; 5) . any disclosure of user's personal privacy information caused by hacker attack, computer virus invasion and other force majeure events; 5. User agrees that wuhui may use user's personal privacy information in the following matters: 1) . wuhui shall send important notices to users in time, such as software update and change of terms of this Agreement; 2) , wuhui internal audit, data analysis and research, etc., have improved wuhui's products, services and communication with users; 3) . according to the agreement, wuhui manages, reviews user information and takes handling measures; 4) Other matters stipulated by applicable laws and regulations; In addition to the above, wuhui will not apply the user's personal privacy information to any other purpose without the user's prior consent. 6. Wuhui attaches great importance to the protection of minors' personal privacy information. Wuhui will rely on the personal information provided by the user to determine whether the user is a minor. Any minor under the age of 18 shall obtain the prior written consent of the parent or his legal guardian (hereinafter referred to as the "Guardian") to register his / her account or use the service. Wuhui will not use chat records and other personal privacy information of minors disclosed to any third party except in accordance with the provisions of laws and regulations and the instructions of the competent authorities. Except for the exceptions agreed in this agreement, wuhui will not use the personal privacy information disclosed to any third party without the prior consent of the guardian. 7. The user confirms that its geographic location information is non personal privacy information, and the user's successful registration of the "app" account is deemed to confirm the authorization of wuhui to extract, disclose and use the user's geographic location information. The user's geographic location information will be disclosed by wuhui to other users as one of the user's public materials. If users need to stop disclosing their geographic location information to other users, they can set their own privacy at any time. 8. Users confirm that their consumption information and income information are non personal privacy information, and the successful registration of the user's "app" account is deemed to confirm the authorization of wuhui to extract, disclose and use the user's consumption information and income information. User consumption information and income information will be made public by wuhui to other users. 9. In order to improve the technology and service of wuhui and provide users with a better service experience, wuhui may collect and use the user's non personal privacy information by itself or provide it to a third party. 10. For account cancellation, information about account registration is provided online. If the account is not authenticated, cancellation cannot be provided. 5、 Content specification 1. Any content transmitted or published by the user in or through the service does not reflect or represent, nor shall it be deemed to reflect or represent the opinions, positions or policies of wuhui, for which wuhui shall not bear any responsibility. 2. Users shall not use the "app" account or the service to conduct the following behaviors: 1) Submit or release false information, or steal other people's avatars or information, or pretend to use other people's name; 2) , forcing or inducing other users to pay attention to, click the link page or share information; 3) Fabricating facts or concealing the truth to mislead or deceive others; 4) Using technical means to establish false accounts in batches; 5) . using the "app" account or the service to engage in any criminal activity; 6) , produce, publish, operate or disseminate methods and tools related to the above behaviors, whether for commercial purposes or not; 7) . other behaviors violating laws and regulations, infringing other users' legitimate rights and interests, interfering with the normal operation of "app" or not expressly authorized by wuhui; 3. The user shall be fully responsible for the authenticity, legality, harmlessness, accuracy and effectiveness of the information transmitted by using the "app" account or the service, and any legal liability related to the information transmitted by the user shall be borne by the user, not related to wuhui. If any damage is caused to wuhui or a third party, the user shall make compensation according to law. 4. The user's content consumption behavior in "app" (content consumption refers to: gift reward in chat room, dynamic gift reward, message gift reward, belonging to gift reward, etc.) is completely based on your independent and voluntary behavior; once the content consumption behavior occurs, there is no refund; the user is responsible for the content consumption by himself; wuhui does not assume any responsibility. 5. The services provided by wuhui may include advertisements, and users agree to display advertisements provided by wuhui and third-party suppliers and partners during the use. Except as expressly provided by laws and regulations, the user shall be responsible for the transaction of the advertising information, and wuhui shall not be liable for any loss or damage suffered by the user as a result of the transaction based on the advertising information or the content provided by the aforesaid advertiser. 7、 Virtual currency 1. Wuhui is launching a virtual currency, the diamond, on the simu platform. The user confirms that the diamond purchased can be used for online and offline order payment service, chat message reward service, dynamic reward service and driving business provided by the product (it does not support the charging of net fish fees, the charging amount of net fish fees is only limited to the consumption of offline net fish stores, and it does not communicate with the diamond in "simu" app). The specific ratio is subject to the display on the service page of diamond related channels purchased by users. Wuhui has the right to change the above exchange rate at any time according to the operation conditions, and will display it on the relevant service page of diamond purchase by users. 2) By default, the user has opened a diamond account for diamond purchase (hereinafter referred to as "recharge") and consumption. The user can find the diamond purchase and consumption records in my wallet. Information about diamonds will not be made public. 3) Users can recharge the diamond account through the diamond recharge channel provided by the platform. The user confirms that it will not recharge in an illegal way or by using a recharge channel not specified by the platform. If the user illegally purchases diamonds by using a purchase channel not recognized by wuhui, wuhui will not guarantee the smooth or correct completion of the purchase. Due to business needs, wuhui has the right to recycle the user's "app" account. 2. Users can change or delete personal data, registration information and transmission content on the "app" account. However, it should be noted that deleting the relevant information will also delete the text and pictures stored in the system. Users are at risk. 3. The user is responsible for keeping the security of the registered account information and account password properly. The user shall be responsible for the theft of the account number or password caused by improper storage. Users need to take legal responsibility for the behavior under the registered account and password. The user agrees not to use the account or password of other users under any circumstances. The user agrees to notify wuhui immediately when he suspects that someone else uses his account or password. 4. The user shall abide by the terms of this Agreement and use the service correctly and properly. If any term of this agreement is violated by the user, wuhui has the right to interrupt or terminate the service provided to the user's "app" account according to the agreement after notifying the user. Meanwhile, wuhui reserves the right to withdraw the "app" account at any time. 5. If the user does not log in for 24 consecutive months after registering the "app" account, after 3 days' notice to the user, wuhui can recover the account to avoid resource waste, and the user shall bear the adverse consequences. 9、 Data storage 1. Wuhui shall not be responsible for the deletion or storage failure of relevant data in the service. 2. According to the actual situation, wuhui can decide the maximum storage period of data in the service, and allocate the maximum storage space for the data on the server. Users can back up the relevant data in the service according to their own needs. 3. If the user stops using the service or the service is terminated, wuhui can permanently delete the user's data from the server. After the service is stopped, wuhui is not obliged to return any data to the user. 10、 Risk taking 1. The user understands and agrees that "app" only provides the user with a platform for information sharing, transmission and acquisition, and the user must be responsible for all behaviors under his / her registered account, including any content transmitted by the user and any consequences arising therefrom. Users should make their own judgment on the app and the content in the service, and bear all risks arising from the use of the content, including the risks arising from reliance on the correctness, integrity or practicability of the content. Wuhui cannot and will not be liable for any loss or damage caused by the user's actions. If the user finds that anyone violates the agreement or uses the service in other improper ways, please report or complain to wuhui immediately, and wuhui will handle it according to the agreement. 2. The user understands and agrees that due to the needs of business development, wuhui reserves the right to change, suspend, terminate or cancel all or part of the service content unilaterally, and the user shall bear this risk. 11、 Statement of intellectual property rights 1. In addition to the intellectual property rights related to advertising in this service enjoyed by the corresponding advertisers, the intellectual property rights of the content provided by wuhui in this service (including but not limited to web pages, words, pictures, audio, video, charts, etc.) belong to wuhui, except that the user has legally obtained intellectual property rights for the content published before using this service. 2. Unless otherwise stated, the copyright, patent and other intellectual property rights of the software on which wuhui provides the service shall be owned by wuhui. 3. The copyright or trademark rights of the graphics, words or their components involved in the service, as well as other wuhui logo, product and service names (hereinafter referred to as "wuhui logo") belong to wuhui. Without the prior written consent of wuhui, the user shall not display or use the wuhui logo in any way or do other processing, nor indicate to others that the user has the right to display, use or other behaviors that have the right to process the wuhui logo. 4. The above and any other intellectual property rights legally owned by wuhui or relevant advertisers are protected by law. Without the written permission of wuhui or relevant advertisers, users shall not use or create related derivative works in any form. 12、 Legal liability 1. If wuhui finds or receives reports or complaints from others about the user's violation of the agreement, wuhui has the right to review and delete relevant contents at any time without notice, including but not limited to user data and chat records. According to the seriousness of the case, the illegal account shall be punished, including but not limited to warning, function sealing, account freezing, equipment sealing, function sealing and permanent sealing, and the user shall be informed of the handling results. 2. The user understands and agrees that wuhui has the right to punish the violation of relevant laws and regulations or the provisions of this agreement in accordance with reasonable judgment, take appropriate legal actions against any user who violates the laws and regulations, and save relevant information in accordance with laws and regulations to report to relevant departments, etc., and the user shall bear all legal liabilities arising therefrom. 3. User understands and agrees that any claim, demand or loss claimed by any third party, including reasonable attorney's fee, caused by or arising from user's breach of this agreement, shall be compensated by user to wuhui, its cooperative companies and affiliated companies, and shall be exempted from damages. 4. The user understands and agrees that if the user violates the agreement and causes wuhui to permanently seal the account, the cash balance, diamond balance and charm value balance in the account will not be withdrawn after the user is permanently sealed. The above cash balance, diamond balance and charm value balance will be regarded as the liquidated damages paid by the illegal users to wuhui, which will be collected and controlled by wuhui. 5. Users (including but not limited to: registered users, blocked users and logout users, etc.) shall not maliciously defame and slander wuhui and related apps; shall not spread relevant comments and untrue reports damaging wuhui and related apps; shall not incite fans and other network groups to maliciously attack wuhui and related apps. Without the written consent of wuhui, any user shall not make comments or accept interviews about wuhui and related apps on any news media, self media and other platforms. If the user violates the above agreement, wuhui has the right to pursue legal liability and claim for damages according to relevant laws and regulations. 13、 Force majeure and other exemptions 1. The user understands and confirms that during the use of the service, it may encounter force majeure and other risk factors, which may cause the service to be interrupted. Force majeure refers to unforeseeable, insurmountable and unavoidable objective events that have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, epidemics and storms, as well as social events such as wars, riots, government actions, etc. When this happens. Wuhui will try to cooperate with relevant units in the first time and repair in time, but wuhui and the cooperative units shall be exempted from liability to the extent permitted by law for the losses caused to users or third parties. 2. This service, like most Internet services, may be disturbed by various security problems due to differences in factors including but not limited to user reasons, network service quality, social environment, etc., such as other people's use of user's information, causing harassment in real life; other software downloaded and installed by users or other websites visited by users contain viruses such as "Trojan horse" , which threatens the security of user's computer information and data, and then affects the normal use of the service, etc. Users should strengthen the awareness of information security and user data protection, and pay attention to password protection to avoid loss and harassment. 3. The user understands and confirms that there is a risk of service interruption or failure to meet the user's requirements due to force majeure, computer virus or hacker attack, system instability, user's location, user's shutdown and any other technical, Internet, communication line reasons, etc. Therefore, wuhui shall not be liable for any loss caused to the user or the third party. 4. User understands and confirms that in the process of using the service, wuhui shall not be liable for any loss of user or third party caused by any information from any other person, including misleading, deceptive, threatening, defamatory, objectionable or illegal information, or anonymous or pseudonymous information infringing the rights of others, as well as any behavior accompanying such information 。 5. The user understands and confirms that wuhui needs to regularly or irregularly repair or maintain the "app" platform or related equipment. If the service is interrupted within a reasonable time due to such circumstances, wuhui does not need to bear any responsibility for this, but wuhui shall notify in advance. 6. According to laws and regulations and this agreement, wuhui has the right to deal with illegal or breach of contract. This right does not constitute the obligation or commitment of wuhui, and wuhui cannot guarantee to discover illegal or breach of contract in time or deal with it accordingly. 7. The user understands and confirms that wuhui shall not be liable for the quality defects of the following products or services provided by wuhui to the user and any losses caused thereby: 8. In no event shall wuhui be liable for any indirect, consequential, punitive, incidental, special or punitive damages, including loss of profits caused by the user's use of the app or the service (even if wuhui has been informed of the possibility of such damages). Notwithstanding anything to the contrary contained in this agreement, the entire liability of wuhui to the user shall not exceed the fees (if any) paid to wuhui by the user for the use of the services provided by wuhui, regardless of the reason or the way of behavior. 14、 Change, interruption and termination of services 1. In view of the particularity of the network service, the user agrees that wuhui has the right to change, interrupt or terminate part or all of the service (including the charging service) at any time. For the service changed, interrupted or terminated by wuhui, wuhui shall notify the user before the change, interruption or termination, and provide the affected user with equivalent alternative service. 2. In case of any of the following circumstances, wuhui has the right to change, interrupt or terminate the free service or charging service provided to the user without any liability to the user or any third party: 1) . according to the law, the user shall submit true information, and the personal data provided by the user is not true or inconsistent with the information at the time of registration and fails to provide reasonable proof; 2) . the user violates the relevant laws and regulations or the agreement; 3) . according to the requirements of laws or authorities; 4) , for safety reasons or other necessary circumstances. 15、 Others 1. Wuhui solemnly reminds users of the clauses in this agreement that exempt wuhui from responsibilities and restrict users' rights. Please read them carefully and consider the risks on your own. Minors shall read this agreement in the company of their legal guardian. 2. Any provision of this agreement is invalid or unenforceable for any reason, and the remaining provisions are still valid and binding on both parties. 16、 Special statement Whereas: Article 39 of the contract law of China stipulates that if a contract is concluded with standard terms, the party providing the standard terms shall follow the principle of fairness to determine the rights and obligations between the parties, and take a reasonable way to draw the attention of the other party to the terms of exemption or limitation of its liability, and explain the terms according to the requirements of the other party.
